Ignorantia juris non excusat, as the Klingons say. I can say it, I am saying it, I'm right, they're wrong, and I'm sure they know that they're wrong. The real question is whether there will ever be any consequences for it. Actually, my real real question is why they even bother. One retailer just makes you tick a "for airsoft and that" box, which I actually respect more than the non-defences. Noooo, not the "why can't real airgun firearms that are realistic imitations of real non-airgun firearms also be realistic imitation firearms" hand-bag fight again! ? But yes, this highlights that nobody really cares. You can buy a much higher powered CO2 steel-BB airgun that looks identical to either the airsoft RIF or real steel version over the counter with nothing more than ID (in principle), and nobody blinks an eye, much less loses it. The State clearly doesn't care, and it won't until some Daily Rant muckraker writes a BOMBSHELL article about how easy is to to get your hands on RIFs. We're actually quite fortunate that investigative journalism is a dying art.3 points

That sounds likely. You could try to record the arrival of the package and the unwrapping, with one continuous video from the moment the delivery guy hands it to you... (Ask him nicely, maybe he'll stick with you for a couple of minutes and he can be a witness too) If it does indeed turn up empty or with a brick in it, that might be useful somehow?3 points -

Proof of postage is worthless He will post you a brick. It will be weighed and tracked and then claim you are the fraudster. Leave all threats on the table until you either have your goods as you sent them or a cash replacement. Paypal is often used against the seller in this type of situation.3 points

Friday will become next Monday, then his dog will eat his crypto-wallet while he's rushing it to the vet after it gets bitten by a radioactive spider, or whatever other fantasy story he comes up with next. Any "proof" of postage he gives you is likely to be fake too, and in the unlikely event that you do receive any package, it's going to be a zip-lock bag containing empty promises and a turd. Sorry to be so harsh, I know you're the victim here, but I cannot see any realistic way that you'll get back what he's stolen short of having it seized by PSNI. I know this feels very personal to you, but this is nothing to him, he's a professional fraudster and liar who has mugged off his real life mates without hesitation or regrets, and is doubtless fobbing off a couple of other victims on the side as we're discussing this. This is just business as usual to him, he'll have heard this all before, many times.3 points -

I'd stress that as being the significant part, and I'd question where "gross" is coming from, since it doesn't appear in the statute and a brief (tee hee) search of https://www.bailii.org/ didn't turn up anything relevant for UTCA 1977 S2 and "gross negligence". The way I view it is that if there's blame there's always a claim. If there isn't blame (negligence), then it's a moot issue as there's nothing to waive. Rather a reductive issue.3 points -

Verification of RIF buyers as private seller
Cannonfodder and one other reacted to ak2m4 for a topic
Funny enough when I mentioned on Facebook that a friend of mine was working on a new 'airsoft defense' system that would be independently audited by an IT security firm on a yearly basis, I still had some people commenting they wouldn't trust the new system, how they were afraid of their details being "out there", even though they were already registered with UKARA had been for years. They were seemingly under some false pretence that the UKARA was stored on a non Internet connected stand-alone PC in some high security vault...2 points -
This conversation has gone on a few times in the forum The majority of members will not endorse ‘defences’ that appear to be evading the law (We know that it’s possible to buy with inappropriate ‘defences) In this thread though, the original question is how can a private seller validate a valid defence2 points
-
It bothers me a bit that UKARA is run by... never you mind. I can't see anything on ukara.org.uk, no general contact information, no phone number. The best I can find from what they're required to publish appears to be a farmhouse in Cornwall. https://ico.org.uk/ESDWebPages/Entry/ZA0319592 points

Here's mine. Its not currently got an engine in and has not had one for 9 months. Bottom end bearings went bye bye. Should be back this month. Not many people are aware of the 4 door R34s and the ones that do take a strange look on them. I personally love them. Maybe its a sign that I'm getting older but ever since I drove a B5 S4 I have been in love with 4 door saloons. The engine being out has been a bit of a blessing, although its been a boring 9 months without the car, its got some goodies going in such as forged pistons and rods, link ecu and a few other goodies.2 points

We can say they aren’t legitimate defences Under legislation the only defences are : Museums theatrical performance Film making / TV (proper filmmaking not being a YouTuber) Crown service (For real duties, not just being a civil servant or soldier) Note that airsoft is not one of them. It’s an additional provision by ‘statutory instrument’ and covers ‘airsoft skirmishing on insured sites’ General shooting, collecting & wall displays are not approved in the law (You can do them with airsoft guns once in your possession but they are not defences under the VCRA) For general shooting you could in theory have no defence required - just sell an airsoft gun with the velocity too high and sell it as an air weapon, for which no defence or licence are required (at least in England & Wales) In which case a shooters membership isn’t needed to validate the sale, but shows the shooter to be a bit responsible Cosplay is also not a valid defence - this is compounded by the retailer who offers it partnering with s comicon that bans entry with RIFs (just like every UK comicon / cosplay event) Note that ‘professional cosplayers’ come under the theatrical defence https://www.legislation.gov.uk/ukpga/2006/38/section/37 37Specific defense applying to the offence under s. 36 (1)It shall be a defence for a person charged with an offence under section 36 in respect of any conduct to show that the conduct was for the purpose only of making the imitation firearm in question available for one or more of the purposes specified in subsection (2). (2)Those purposes are— (a)the purposes of a museum or gallery; (b)the purposes of theatrical performances and of rehearsals for such performances; (c)the production of films (within the meaning of Part 1 of the Copyright, Designs and Patents Act 1988 (c. 48)_see section 5B of that Act); (d)the production of television programmes (within the meaning of the Communications Act 2003 (c. 21)_see section 405(1) of that Act); (e)the organisation and holding of historical re-enactments organised and held by persons specified or described for the purposes of this section by regulations made by the Secretary of State; (f)the purposes of functions that a person has in his capacity as a person in the service of Her Majesty.2 points

Verification of RIF buyers as private seller
Cannonfodder and one other reacted to Tackle for a topic
Those weren't legitimate defences, but I suspect given the historical lack of prosecutions with regards to airsoft vs vcra, some retailers have chosen to move their own goalposts to suit themselves, likely they feel it's an acceptable risk given the economic pressures most are facing.2 points -
Retailers don't create the law and are certainly not above the law. Just because they regularly flout the law, doesn't make it right. Only takes one noticeable incident to screw it up for everyone.2 points

And as I said, those aren't defences. This is relevant because the OP is asking how he'd verify a real one. Credible, but I'd suggest not actually needed. It's also pretty irksome for the shrinking number of retailers, like PatrolBase, who do actually care about staying on the right side of the law, because if the winds do change regarding toy guns, they're going to get punished as much as the rogues, and we'll all suffer for it.2 points

Those could be valid shooters, but not VCRA defences You can go target shooting with an IF just as well as with a RIF - the law does not recognise the ‘immersion’ for target shooting @aiden UKARA / site membership ought to be verifiable with the site Legally you don’t need any evidence, but you as seller become liable to a major fine if the RIF you sell comes to the attention of the law and they wonder how Joe chavvie got hold of it You need to reasonably satisfy yourself that the buyer intends to use it for airsoft, and may need to prove that in court UKARA or site membership are winners Photos of them playing or a history of forum contribution* could be usable You could paint it into an IF and legitimise a sale - but if a RIF is worth selling then somebody will turn up who can show a defence *Note that I’m a regular forum contributor, but I don’t have a Defence, don’t play & don’t intend to play - and many of my posts say so - so don’t sell a RIF to me Most people on here are interested in playing But also beware of underage buyers - the reason they can’t show a defence might be because they are not eligible to a defence2 points

To expand on what @Tommikkasaid, what I think[*] sites should be doing is explaining: 1) What to expect. We often see this in the form of "physical exertion" or similar. 2) What duties of care they think the players owe to ourselves and to each other, like wearing eye protection, calling hits and raising a hand, removing mags/clearing guns, and responding to "Man down / cease fire" calls. 3) Setting out the duties of care they think that the site owes to the player. I've yet to see a site really do the 3rd one, and far too many sites seem to think that they can use a waiver to avoid any responsibility with a clause about agreeing not to sue them, for anything, under any circumstances, even when they are negligent with respect to a duty of care. That's specifically prohibited in law, as referenced above and quoted below. Absolutely in the case of death or personal injury, and with a reasonableness test for loss or damage - for example, if a marshal rageflips and smashes your gun against a tree, they can't then say "Cry harder, you agreed you can't sue us for anything." We explicitly cannot waive those rights. [*] Disclaimer/waiver! This is based on a couple of days of H&S liability avoidance training several decades ago, this advice comes without warranty, including fitness for any purpose.2 points -

Hello Before you waste any money on it at all be aware of what you have got and if it is something you are actually going to keep. I ran mine for a bit then sold it, it just wasn't good enough. The MP7 AEP is great if you want a very quiet, close up gun.. That is about it. ( Other guns like the Gas TM Mk23 do it better ) What it does not do well, is rapid fire semi/auto ( put ... put .. put ) or handle power upgrades well. Both will end up with the AEP exploding and you having zero access to spare parts. I personally would do what i did. Solder some wires and a dean connector onto the existing contacts and then a fake PEQ or similar to hold a 7.4v lipo. You can get small batteries that fit into the existing area but are a chore to get in and out i found. PEQ on an MP7 look boss anyway. Giving that it functions well. You will have a neat little gun that is excellent, if you do not want to be heard but aren't going into a heavy fight. ( Mk23 does it better ) The power mentioned before is about 260-280 but range is ok. It just take an age to get there. The GBB TM MP7 on the other hand1 point

The missing cap has no function except to cover the hole. In real steel, that's the magazine tube holding the shells, here it is an empty tube. Shells should be easy to find. Shells function as a magazine here. Check if the gas tank is not leaking, should be in the grip.1 point

Me and a mate both got Billet SBR's. Had a good weekend testing mine out. Unfortunately my mates had an issue where air was constantly coming out of the barrel, even without pressing the trigger. We checked what we could but he has sent it off for a replacement. He's understandably put off by the whole thing but hopefully a new unit will get him back on track ? Mine has been pretty solid. I got it within 1 FPS of the limit with only 1 adjustment so ill take that was a win. My hop seems to be non existent or shooting for the moon but i'm sure once its bedded in it should be mint1 point

Heavier BBs, 0.36 to 0.40, Most Cost Effective To Buy In 2022?
leadly reacted to Cr0-Magnon for a topic
For a DMR? IMO, 0.28's are just right for a sub 350fps general rifle They'd be coming out around 280 - 290fps. For DMR's which shoot circa 440fps on a 0.20g, I'd use a minimum of 0.32g's. I've probably got it wrong but something about lower speed projectiles being subjected to less drag, plus the increased weight should be that little bit less affected by wind (light breeze) etc. I will also add that providing your gun can lift them, you can of course use a chrono to check joule/FPS and ascertain which weight is most suitable. For example the previous rubber and nub combo I used, caused a big drop in FPS as soon as I adjusted for a heavier BB. In those cases I would say there's no point shooting a 0.43g at 1.5J compared to 0.32 or .36 at 1.8.1 point -

I've started running 0.36's through my MTW but as an AEG's. A 3 shot burst really does take people by surprise! A fair bit of range gained and not that much slower than 0.32 either. I don't play that often so don't mind the added expense. I hate seeing people get sad or angry because their 0.25's won't chop through a bush or hit the baddies past 30m's.1 point

It's completely fine, in Poland the upper limit for most rifles is 450fps. I don't want to change the ratio, all I really need is a proper set of gears that wont break after one or two mags.1 point

See now, what you need to do there is take the 3x magnifier off, put it in a draw, go play airsoft and sell the magnifier in 6 months. This will save you the hassle of lugging it around all day just to discover that it's 3 parts of fuck all use. Alternatively, the should be elevation and windage adjusters on the magnifier or possibly on the mount base that will help you re-centre the reticule. Unfortunately, there is EVERY likelihood that when you first flip the magnifier to one side and back again it'll be off centre again because NONE of the cheap magnifiers are actually any good (please see my previous comment above).1 point
